2.  Nature of Creative Playground Events

2.1  Overview

Creative Playground designs and delivers immersive creative experiences — including multi-day retreats and shorter workshops — that invite Participants to explore, connect, and engage creatively within a supported community environment.

2.2  What the Operator Provides

Unless otherwise expressly stated in the Event description, the Operator provides only the core Event services described for the relevant Event. The Operator does not undertake to provide a travel package or combined travel arrangement unless expressly stated otherwise in a separate written offering.

  • Any accommodation services only where, and to the extent, expressly stated in the Event description or Confirmation of Participation;
  • Meals, food, and beverages during the scheduled programme, subject to Clause 2.4;
  • The creative workshop or retreat programme, including Event Materials, facilitation, and Igniter contributions;
  • Any supplementary experiential activities expressly described as part of the Event programme; provided that, where reasonably necessary due to circumstances beyond the Operator’s control, the Operator may substitute individual activities with alternatives of substantially equivalent character and value, without changing the essential nature of the Event.

2.3  What the Operator Does Not Provide

The following are expressly excluded and must be independently arranged and funded by each Participant:

  • All travel and transportation to or from the Event location, as well as any travel not expressly described as part of the Event services, including flights, trains, taxis, and transfers;
  • Personal travel, medical, cancellation and liability insurance (see Clause 8);
  • Alcoholic beverages, unless expressly included in the Event description;
  • Personal expenditures and activities outside the Event programme; and
  • Any medical, therapeutic, or psychological treatment.
  • Any visa, entry permit, residency authorisation, or other immigration requirements necessary to attend the Event, including ensuring compliance with applicable entry, visa waiver, and duration-of-stay regulations of the Event location.

2.4  Dietary and Allergen Requirements

Catering is provided at Events where stated in the Event description. Participants should disclose relevant dietary requirements and known allergies during the application process or without undue delay thereafter. The Operator will use reasonable endeavours to take disclosed requirements into account but cannot guarantee a completely allergen-free environment. Liability remains governed by Clause 14.

2.5  ACE Creative Flow Framework

All Events are designed using the Operator’s proprietary ACE Creative Flow Framework. This is the exclusive intellectual property of the Operator. Nothing in these Terms or participation in any Event grants any Participant any right, licence, or interest in this framework.

2.6  Voluntary Co-Hosting by Participants

The Operator may invite individual Participants to take on voluntary co-hosting roles (Volunteer Participant-Hosts) during an Event. Such invitations are at the Operator’s sole discretion, are unpaid and voluntary, and do not create any employment or contractual relationship. Full provisions are in Clause 12.

3.  Application Process and Selection

3.1  Applications and Eligibility

Places are limited and offered by application only. Submission of an Application does not constitute acceptance or create a binding contract. The Operator may accept or decline Applications on the basis of suitability for the Event format, group composition, capacity, safety, or other legitimate business reasons.

All Participants must be at least 18 years of age at the date of the Event. By submitting an Application, the Applicant confirms they meet this requirement.

3.2  Selection Interview

Upon submitting the Application, Applicants are requested to schedule a video call. The purpose is to assess alignment with the creative and community nature of the Event, allow the Applicant to ask questions, and enable the Operator to curate an appropriate group dynamic. Selection criteria are based solely on suitability for the Event format.

3.3  Formation of Contract

A binding contract is formed only when: (i) the Operator issues a written Confirmation of Participation; and (ii) the Participant pays the Reservation Fee in full within 7 calendar days after receipt of that confirmation, unless a different deadline is expressly stated in the confirmation. If timely payment is not received, the Operator may release the place for reallocation.

3.4  Spot Transfer

A Participant who cannot attend may, with the Operator’s prior written consent, transfer their place. Conditions:

  • The proposed transferee must apply and be accepted through the standard selection process;
  • An administration fee of €100 is payable by the transferring Participant;
  • If a transfer is approved and completed, sums already paid by the original Participant may be credited towards the transferee’s booking to the extent agreed by the Operator and the parties concerned; the Operator may deduct the administration fee and any additional demonstrably incurred costs.
  • The transferee must accept and is bound by these Terms, the Privacy Notice, and the Playground Rules independently; and
  • Transfer requests must be made in writing to hi@creative-playground.com at least 14 calendar days before the Event.

4.  Participation Fees and Payment

4.1  Total Participation Fee

Fees are published on the Website and quoted in Euros (EUR) including VAT. Where an Event offers shared and single room options, fees vary by room type and will be confirmed in the Confirmation of Participation.

4.2  Reservation Fee

A reservation deposit of €500 is due within 7 calendar days of the Confirmation of Participation and will be credited towards the Total Participation Fee. In the event of Participant cancellation, the treatment of that amount is governed exclusively by Clause 5 and not by a separate blanket non-refund rule.

4.3  Remaining Balance — Flexible Payment

The Remaining Balance is confirmed individually with each Participant following acceptance. Upon request, the Operator may offer flexible payment options, including instalments. All sums must be paid before commencement of the Event. If a Participant fails to pay an agreed amount by the applicable due date, the Operator may, after giving a reasonable reminder and a short additional payment period, withdraw the Confirmation of Participation and cancel the booking. In that case, Clause 5 applies to determine any amount retained or refunded.

4.4  Payment Methods

Payments must be made using the permitted payment methods communicated by the Operator. Participants may not set off counterclaims unless the counterclaim is undisputed, ready for decision, or arises from the same contractual relationship. Any bank charges and currency conversion costs remain the Participant’s responsibility.

5.  Cancellation, Withdrawal, and Refund Policy

5.1  Cancellation by the Participant

Written notice of withdrawal must be sent to hi@creative-playground.com. The following policy applies:

Notice Period prior to the Event dateCancellation consequences
More than 60 days beforeThe Operator may retain the Reservation Fee as a reasonable lump-sum cancellation charge. Any amount paid beyond the Reservation Fee will be refunded within 14 days, unless a higher amount is justified under the following rows.
31–60 days beforeThe Operator may retain the Reservation Fee and, in addition, charge 25% of the Remaining Balance as a reasonable lump-sum cancellation charge, unless the Participant proves that no loss or substantially lower loss was incurred.
30 days or fewer before, or no-showThe Operator may retain the Reservation Fee and charge 100% of the Remaining Balance, unless the Participant proves that no loss or substantially lower loss was incurred.
Emergency / medical caseClause 5.2 applies. The Operator will review the case in good faith and may offer rebooking, credit, a reduced cancellation charge, or a refund where appropriate.
Operator cancels EventFull refund of all sums paid within 14 days or, at the Participant’s express choice, a credit for a future Event.

The cancellation charges above reflect the Operator’s ordinary expectation of saved expenses, committed third-party costs, and the difficulty of filling places at short notice. Participants remain free to prove that no loss or substantially lower loss was incurred in the individual case.

5.2  Emergency and Medical Circumstances

Where a Participant faces a genuine emergency, including a serious medical situation affecting the Participant or an immediate family member, the Operator will review the circumstances in good faith and endeavour to find a fair and proportionate outcome. Depending on timing, resalability of the place, and costs already committed, this may include rebooking, a credit, a reduced cancellation charge, or a partial refund.

To request consideration, the Participant must notify the Operator in writing as soon as reasonably practicable and provide appropriate supporting documentation on request. Nothing in this Clause limits any mandatory statutory rights.

5.3  Credit Terms

Any credit issued under Clause 5 is valid for 12 months from the original Event date, personal to the Participant unless the Operator agrees otherwise in writing, and may be applied only to future Creative Playground Events. A credit is not redeemable for cash unless mandatory law requires otherwise.

5.4  Operator Cancellation

The Operator may cancel an Event if the minimum number of confirmed participants stated in the relevant Event description is not reached by the deadline stated there, or where performance is prevented or materially impeded by force majeure or other circumstances beyond the Operator’s reasonable control. In that case, each Participant may choose either (a) a full refund of all sums paid within 14 days or (b) a credit for a future Event. Unless impossible in the circumstances, the Operator will give reasonable advance notice of cancellation.

5.5  Operator Modifications

The Operator may make reasonable changes to the programme, Igniters, schedule, activities, or venue where this is necessary and the overall nature of the Event is not materially altered. Where a change materially affects the Event and is disadvantageous to the Participant, the Operator will notify Participants without undue delay and grant them the right to cancel the booking for a full refund of sums paid, unless the change is insignificant.

5.6  EU / German Statutory Rights

Where the contract qualifies as a contract for the provision of leisure-related services for a specific date or period within the meaning of applicable German consumer law, a statutory right of withdrawal may be excluded. To the extent a statutory withdrawal right exists in the individual case, it remains unaffected. The Operator’s cancellation provisions apply in addition to, and do not limit, mandatory statutory rights.

6.  Participant Conduct and Playground Rules

6.1  Obligation to Comply

All Participants must comply with the Creative Playground Rules, incorporated by reference into these Terms. By accepting a Confirmation of Participation, each Participant confirms agreement to the Playground Rules  for the entirety of the Event.

6.2  Core Obligations

Without limiting the Playground Rules, all Participants must at all times:

  • Treat all Participants, Igniters, staff, and third parties with courtesy, dignity, and respect;
  • Refrain from harassment, discrimination, intimidation, or threatening behaviour of any kind;
  • Respect the confidentiality of personal disclosures and creative works shared within the group;
  • Not photograph or record other Participants or Igniters without their explicit prior consent;
  • Not solicit commercial business from other Participants without the Operator’s written consent;
  • Comply with venue rules, and health and safety requirements; and
  • Not attend under the influence of alcohol or substances to a degree that impairs participation or affects others, and to ensure they are acting in compliance with all applicable laws and regulations.
  • Participants are not permitted to invite, bring, or otherwise grant access to any third party (including but not limited to friends, family members, colleagues, or acquaintances) to event activities, sessions, or the event venue without the prior written or explicit consent of the event operator. Any unauthorized person present at the venue or participating in any activity as a result of a participant’s invitation may be asked to leave immediately. The operator reserves the right to take further action, including the removal of the inviting participant, in the event of a violation of this clause.

6.3  Removal from an Event

The Operator may require a Participant to leave an Event, or exclude the Participant from individual activities, where this is reasonably necessary due to a material breach of the Playground Rules or these Terms, or for safety reasons. In such a case, the Participant remains liable only for the part of the price corresponding to services already provided and for any additional costs or damages caused by the breach, subject always to mandatory law.

7.  Health, Safety, and Participant Responsibility

Events may involve light physical movement, sensory activities, outdoor experiences, and hands-on creative work. Participants are solely responsible for assessing their own physical and mental fitness. The Operator does not provide medical, therapeutic, or clinical services. Nothing in any Event programme constitutes medical or clinical advice.

Participants must follow all health and safety instructions from the Operator, Igniters, and venue staff. The Operator may exclude from any activity any Participant whose participation poses a safety risk.

8.  Insurance

Unless expressly stated otherwise in the Event description, the Operator does not arrange individual travel, health, accident, cancellation, or personal liability insurance for Participants. Participants are strongly advised to obtain appropriate insurance cover for the Event. This Clause does not limit any liability of the Operator that cannot be excluded under mandatory law.

9.  Intellectual Property — Operator’s Rights

9.1  Operator IP

All intellectual property in the Website, Event Materials, ACE Creative Flow Framework, Creative Playground name and brand, and all other Operator-produced content is the exclusive property of the Operator. Participation in any Event grants no Participant any right, licence, or interest in any Operator IP.

9.2  Event Materials — Permitted Use

Event Materials are provided for Participants’ personal, non-commercial use only. Participants may not reproduce, distribute, adapt, or commercially exploit Event Materials without the Operator’s prior written consent.

10.  Intellectual Property — Participant Works

10.1  Independently Created Works

Subject to Clauses 10.2 and 10.3, Participants retain ownership of Guest Participant Work created independently, outside structured collaborative exercises forming part of the Event programme.

10.2  Licence — Programme-Integrated Works

By attending an Event and creating Guest Participant Work in the context of the Event programme, each Participant grants to the Operator a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to: (i) use, reproduce, display, and share such work solely for documenting and promoting Creative Playground Events (including on the Website and social media); and (ii) create internal derivative works for programme development, not for commercial exploitation without separate consent.

10.3  Assignment — Jointly Created Works

Where Guest Participant Work is created jointly with the Operator, an Igniter, or other Participants as part of a structured collaborative exercise, each Participant grants to the Operator, to the extent of that Participant’s rights in the jointly created work, a non-exclusive, worldwide, royalty-free licence for the duration of the relevant rights to use, reproduce, adapt, publish, and make the work available for the purposes of operating, documenting, and promoting Creative Playground and developing future programmes. Any commercial exploitation going materially beyond those purposes requires a separate agreement where mandatory law so requires.

10.4  Moral Rights

Moral rights are inalienable under German and EU law and cannot be assigned. Nothing in these Terms extinguishes moral rights. However, each Participant agrees not to exercise moral rights in any manner that prevents or restricts the Operator’s use of works pursuant to Clauses 10.2 and 10.3.

11.  Igniters and Local Artisan Collaborators

Events may feature Igniters — including local artisans and creative professionals — engaged by the Operator as independent freelance contractors. These collaborators are not employees or agents of the Operator. The Operator is not responsible for independent acts or omissions of Igniters beyond what is included in the Event programme. All Igniters engaged by the Operator are bound by separate agreements covering IP assignment, confidentiality, and conduct.

12.  Volunteer Participant-Hosts

12.1  Voluntary Nature

During an Event, the Operator may invite a Participant to serve as a Volunteer Participant-Host — hosting or co-hosting a short session as part of the programme. Such invitations are entirely at the Operator’s discretion, unpaid, voluntary, and do not create any employment or contractual relationship.

12.2  IP Assignment and Licence — Volunteer Session IP

The Volunteer Participant-Host:

  • Grants an irrevocable, worldwide, royalty-free, perpetual, sublicensable licence to use, reproduce, adapt, publish, display, and exploit the Volunteer Session IP in any format, including on social media, the Website, in marketing materials, and in future Creative Playground Events; and
  • Irrevocably waives any claim to royalties, residuals, or other compensation for the Operator’s use of the Volunteer Session IP.

Moral rights in Volunteer Session IP remain with the creator as provided by law. The Volunteer Participant-Host agrees not to exercise moral rights in any manner that restricts the Operator’s use of the Volunteer Session IP.

13.  Images, Video, and Testimonials

13.1  Event Documentation

The Operator may document Events through photography and/or video recording. Participation in documentation for promotional use requires separate, specific consent obtained at or before the Event. No Participant will be identifiably filmed or photographed for promotional use without their explicit prior consent.

13.2  Participant Recording

Participants may not photograph or record other Participants, Igniters, or venue staff without their explicit prior consent. Personal, non-commercial photographs of the Event environment — not featuring identifiable individuals without consent — are permitted.

13.3  Testimonials

The Operator may use participant testimonials for promotional and commercial purposes, including on the Website, social media, and in marketing materials. Testimonials will not be attributed to an identifiable individual without that participant’s prior consent.

14.  Liability and Indemnification

14.1  Limitation of Liability

The Operator is liable without limitation in cases of intent, gross negligence, injury to life, body or health, and wherever liability cannot be excluded under mandatory law. In cases of slight negligence, the Operator is liable only for breach of essential contractual obligations and then limited to the foreseeable damage typical for the contract. To the extent permitted by law, liability for indirect or consequential loss and for loss of personal property not taken into custody by the Operator is excluded. This limitation also applies in favour of the Operator’s legal representatives and vicarious agents.

14.2  Mandatory Liability — No Exclusion

Nothing in these Terms limits or excludes liability for: (i) death or personal injury caused by the Operator’s negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be excluded or limited under applicable mandatory law.

14.3  Participant Indemnification

Each Participant shall be liable to the Operator for damages and costs incurred as a result of: (i) a culpable breach of these Terms or the Playground Rules; (ii) negligent or wilful acts or omissions during an Event; or (iii) unlawful infringement of any third party’s rights. Any liability of the Participant shall be subject to the applicable statutory provisions.

15.  Data Protection and Privacy

The Operator processes personal data in accordance with the Privacy Notice made available on the Website. Applicants should review that notice before submitting an Application.

16.  Amendments

The Operator may update these Terms for future Applications and future contracts. The version made available to the Applicant before conclusion of the contract and in force at the time of the Confirmation of Participation governs the relevant booking, unless a later change is expressly agreed with the Participant.

17.  Governing Law, Jurisdiction, and Dispute Resolution

17.1  Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

17.2  Jurisdiction

If the Participant is a consumer, the statutory rules on jurisdiction apply. If the Participant is a consumer without general venue in Germany, or if the Participant is a merchant, legal person under public law, or special fund under public law, Hamburg, Germany, is the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms, to the extent permitted by law. The parties will attempt good-faith negotiation before commencing proceedings.

17.3 German Consumer Dispute Resolution

The Operator is not obligated to and does not elect to participate in consumer arbitration proceedings under the VSBG. Participants with complaints should contact hi@creative-playground.com in the first instance.

18.  Miscellaneous

18.1  Entire Agreement

These Terms, together with the Playground Rules, any applicable Privacy Notice, and the relevant Confirmation of Participation, govern the contractual relationship in relation to the relevant Event. Mandatory statutory rights and any pre-contract information that must remain binding under applicable consumer law remain unaffected.

18.2  Severability

If any provision is found invalid, illegal, or unenforceable by a competent court, it will be severed to the minimum necessary extent. The remaining provisions continue in full force.

18.3  Waiver

No failure or delay by the Operator in exercising any right constitutes a waiver of that right. Waivers must be in writing to be effective.

18.4  Assignment

The Operator may assign or transfer rights and obligations under these Terms only where this does not adversely affect the Participant’s legitimate interests. Participants may not assign their rights or obligations without the Operator’s prior written consent, except as expressly provided in Clause 3.4.

These Playground Rules form part of the Creative Playground Terms and Conditions of Participation and apply to all Participants, Volunteer Participant-Hosts, Igniters, and other attendees during Creative Playground Events and related official online communications. By accepting a Confirmation of Participation, each Participant agrees to comply with these Playground Rules for the duration of the Event.

Creative Playground is built on the belief that everyone is creative. Our Events are spaces of genuine openness, trust, and mutual respect. These Playground exists not to restrict you, but to protect the conditions that make real creative exploration possible — for you and for everyone who plays alongside you.

Rule 1.  Respect Your Playmates

We are all equal here. Treat every person — every Playmate, Igniter, venue host, and member of the local community — with fundamental human decency.

Creative Playground maintains absolute zero tolerance for racism, sexism, discrimination, harassment, or any behaviour that demeans, intimidates, or excludes others. This includes verbal, physical, and online conduct.

Respect the physical, emotional, and personal boundaries of those around you — including the right not to participate in any activity. Keep personal beliefs, ideologies, and unsolicited opinions to yourself. Never force them on others.

If you witness behaviour that makes another person feel unsafe or disrespected, you are encouraged to speak to the Operator or an Igniter immediately.

Rule 2.  Play Constructively

We operate on a ‘Yes, and…’ mentality. Build on the ideas of others. Actively lift each other up. Offer constructive feedback only when someone explicitly asks for it.

Suspend judgment — of others and of yourself. Focus on helping your peers explore and succeed, not on evaluating or comparing.

Respect others’ creative work. Do not copy, reproduce, damage, alter, or claim the creative work of another Participant or Igniter without their explicit permission. Unauthorised use of another person’s creative work during or after the Event may constitute intellectual property infringement.

A Playground is not a competition. There is no ranking, no winner, and no correct answer.

Rule 3.  Cherish the Toys

The equipment, materials, and physical space are shared with the whole community. Treat all tools, materials, and the venue with care. Avoid unnecessary waste. Always clean up your workspace when you finish.

If something is damaged or malfunctions, report it to the Operator or Igniter immediately so it can be repaired or replaced. Do not attempt to conceal damage.

Prioritise safety at all times. If you are unsure whether an activity or use of equipment is safe, ask first.

Rule 4.  Embrace the Mess

Trust the creative process — even when, especially when, it feels uncertain, messy, or unresolved. Acknowledge your own edges and limits without judgment.

Remember that perfection does not exist here. The Playground is a space for exploration, not execution. Focus entirely on your own growth and experience.

Open yourself actively to new approaches, unfamiliar methods, and perspectives you haven’t encountered before. Avoid comparing your process or output to what others are doing.

It is okay to feel uncomfortable. Discomfort is often where the most meaningful creative growth happens.

Rule 5.  Keep It Human

Appreciate what others give — your genuine thanks make each Playground better for everyone who plays here.

Share your knowledge, energy, and resources freely. Generosity of spirit is the currency of this community.

Be present. Put away distractions. Give your full attention to the people and experiences in front of you.

Most importantly: have fun. Curiosity, laughter, and play are not extras — they are the whole point.

Additional Provisions

Photography, Video, and Recording

You may not photograph, video record, or make audio recordings of other Participants, Igniters, or venue staff without first obtaining their explicit, individual consent. This applies in all spaces — formal sessions, informal gatherings, meals, and accommodation.

Personal photographs of the Event environment — not featuring identifiable individuals without their consent — are permitted for personal, non-commercial use.

Where the Operator arranges Event photography or video documentation, Participants will be informed in advance and separate consent will be sought for any promotional use of images in which they are identifiable.

Confidentiality

What is shared in the Playground stays in the Playground. Personal disclosures, creative vulnerabilities, individual stories, and group conversations shared during Events are confidential. Participants may take personal learnings away with them but must not identify, repeat, or reproduce the personal disclosures of others outside the Event context without explicit consent.

Intellectual Property — A Reminder

The creative work you produce during the Event is shaped by the collaborative environment and the Operator’s proprietary ACE Creative Flow Framework. Your rights in works you create independently are governed by the Terms and Conditions. Works created jointly with the Operator or as part of structured programme exercises are subject to the IP provisions in the Terms and Conditions. You may not copy, reproduce, or distribute the Operator’s Event Materials or the ACE Creative Flow Framework without written consent.

If you are invited to serve as a Volunteer Participant-Host, you will be asked to sign a separate Consent and IP Assignment form before your session. Serving as a Volunteer Participant-Host is always voluntary and always documented separately.

Commercial Solicitation

Creative Playground Events are not networking or sales events. You may not promote commercial products, services, or opportunities to other Participants without the Operator’s prior written consent. Subtle or indirect solicitation is equally not permitted.

Health, Safety, and Wellbeing

You are responsible for assessing your own physical and mental readiness to participate in Event activities. If at any point during the Event you feel unwell, unsafe, or unable to continue, please inform an Igniter or the Operator immediately. We will always do our best to accommodate your needs.

Please do not attend an Event if you are feeling unwell in a way that may affect other Participants. If you become unwell immediately before an Event, contact the Operator as soon as possible.

Alcohol and Substances

Please drink responsibly. Do not attend any part of the Event programme under the influence of alcohol or controlled substances to a degree that impairs your participation or affects the experience of others. The Operator reserves the right to ask any Participant who appears significantly impaired to withdraw from an activity or from the Event.

Online Conduct

These  Playground Rules extend to online communications related to the Event — including group chats, social media posts, and email correspondence with other Participants and the Operator. The same standards of respect, honesty, and constructive engagement apply online as in person.

Consequences of Breach

The Operator takes breaches of these Playground Rules seriously. Depending on the nature and severity of the breach, the Operator may:

  • Issue a formal reminder or warning;
  • Require the Participant to withdraw from a specific activity or session;
  • Require the Participant to leave the Event immediately or exclude the Participant from particular activities, subject to the refund and payment consequences set out in the Terms and Conditions; and/or
  • Take further action, including notification of relevant authorities, where the breach involves unlawful conduct.

Any action taken in conduct matters will be assessed in good faith and in light of the seriousness of the breach, participant safety, and the integrity of the Event. Financial consequences of removal are governed by the Terms and Conditions.

Where a Participant is concerned about the conduct of an Igniter or the Operator’s own staff, they are encouraged to raise this directly with the Operator at hi@creative-playground.com. All complaints will be taken seriously and handled with discretion.

A Final Word

These Playground Rules exist because Creative Playground events work — creatively, communally, and personally — when everyone feels safe, respected, and genuinely free to explore. These rules are not a bureaucratic formality. They are the foundation of everything we build together.

We are grateful you are here. Now go play.
